Warranty Coverage

Subject to the limitations outlined below, NOVAK Painting & Finishing ("the Contractor") warrants that for two (2) years from the completion date of the work listed on the front of this contract, we will repair areas where paint is peeling, blistering, or chipping due to defective workmanship.

Exclusions – What This Warranty Does Not Cover

This warranty does not apply to the following:

• Work where paint or materials were not supplied by NOVAK Painting & Finishing.

• Any work not performed by NOVAK Painting & Finishing.

• Varnished surfaces or galvanized metal surfaces.

• The cost of paint or materials needed for repairs.

• Horizontal surfaces or surfaces prone to moisture collection (e.g., decks, stairs, railings, porches, wood gutters, flat roofs).

• Exact color or finish matches, as all paints are affected by environmental conditions over time.

• Paint defects, regardless of whether the paint was supplied by NOVAK Painting & Finishing or the client.

• Issues caused by:

• Knot bleeding, rust, or natural oils in wood (e.g., cedar).

• Cracks in drywall, plaster, or wood.

• Mill-glazing on smooth cedar.

• Normal wear and tear or misuse.

• Peeling caused by underlying paint layers existing before our work.

• Structural movement, settlement, or moisture content of the substrate.

• Damage due to mechanical abrasion, harsh cleaning methods, or exposure to chemicals.

• Acts beyond our control: fire, flood, severe weather, vandalism, or other similar events.
  

Scope of Repairs

Repairs will be limited to the specific affected areas and will follow the original surface preparation level outlined in your contract. We do not guarantee full-area repaints or aesthetic blending with surrounding surfaces.

To Qualify for This Warranty

To ensure your warranty is valid, the following conditions must be met:

• The full contract amount must be paid.

• You must retain:

• A copy of the original contract, and

• Proof of full payment (cancelled cheque, receipt, or other form).

• You must pay for any materials required for the repairs.

• The property must be made accessible to NOVAK Painting & Finishing for inspection and repairs.

Limitation of Liability

This warranty is the only express warranty provided by NOVAK Painting & Finishing. It replaces all other warranties, express or implied. It is valid only for the original purchaser named in the contract and is non-transferable.

In no event shall NOVAK Painting & Finishing be liable for:

• Any incidental or consequential damages

• Damages exceeding the original contract value

No verbal agreement or communication may alter or extend this warranty unless made in writing and signed by all parties to the contract.

Legal Rights

This warranty provides specific legal rights, which may vary depending on your province or territory. Some jurisdictions do not allow limitations on implied warranties or the exclusion of incidental or consequential damages.
